Of Ruto, sex, corruption and politics

There is a lot of hubbub around Ruto’s declaration that he will be gunning for the Presidency. Though not new, (Remember his dismal bid in 07) the media splurge has concentrated their lens on his vituperations and puerile indignation against Raila and not the odds against his grandiose project. The battlefield is the Kalenjin Rift Valley. A keen observer will most likely find out that Ruto’s rabid attempt to balkanize the Kalenjin Community from the rest of the country is for bargaining purposes rather than a credible stab at the presidency. But since he insists that he is serious about it, then we must shift the scenario of the debate from Rift Valley to Kenya and weigh his chances objectively vis-à-vis personality, resources at his disposal, organizational ability, issues and appeal with the international community.

Personality

William Kipchirchir Ruto’s personality in public is genial and affable. A wide grin and a tight handshake are always on the ready. However, knowing him closely will reveal a cocky and derisive person especially when dealing with the poor, his workers and staff. Interviews with employees and members of the public, who have interacted with him, paint a picture of a harsh snob who has no time for the unfortunate. He sneers, scowls and shout at you whenever you ask for a job or favor. His smiles are reserved for the cameras and public rallies. Even MPs who follow him around have in many occasions been snubbed and shouted at. He wears his amicable self when seeking favors from those who are equally or more moneyed than him. He dismisses other people as fools, his favorite adjective.

Ruto never keeps friends unless convenient and useful for that time. In fact, he does not have a single friend. The MPs who traversed the country with him in his ill-fated shot for the Presidency in 07 were all dumped as soon as they lost in the ODM nominations. Besides, he did not come to their financial aid prior to the nominations but rushed to finance whoever won. Those who were presumed to be close to him like former Eldoret East MP Joseph Lagat and former Kipkelion MP, Dr Sam Rutto are languishing silently and cursing Ruto publicly. The story is the same for his former allies in the last parliament. He ignores their calls and openly snubs them whenever they visit him at Kilimo House. He has taken the art of use and dump to a whole new level.

In terms of corruption, he could be the most shady and fraudulent presidential candidate ever. A legion of corruption cases are pending in court. The maize scandals are still fresh. His AMACO insurance business is notorious for tax evasion. His hotel under construction opposite Wilson Airport sits on stolen land. His Easton Apartments in Jogoo Road was built with stolen cement from Portland Cement. His flat under construction in Rongai is on a disputed plot. The list is endless. All Ruto’s wealth is ill-gotten and I wonder whether any sober Kenyan will even contemplate electing him. In fact, he had grabbed a public road reserve connecting State House to Uhuru Park!

His escapades with women are legendary. He is risqué and immoral in all extent of the meaning of that word. It is not uncommon to see young girls queuing for sex and money in his private office in Transnational Plaza every evening. He had converted his Continental House Office to a brothel before being appointed a minister. His aides claim that he cavorts with at least three women in a day. MPs have been warned not to introduce their wives or daughters to him. His home is crowded with children from extra-marital affairs not to mention a dozen others he has fathered. Relationship with his wife is nothing to write home about. His family saga is already in the public domain. One thing that baffles his aides and accomplices is that he never use any form of protection! It is unimaginable to have this sex maniac as a role model for our children in this time and age.

There is a widespread misconception that Ruto is a very generous man. It cannot be further from the truth. The truth of the matter is that he buys influence. He is indeed a master of cash diplomacy. Whenever there is a hot issue or a function he would want to appear before the cameras, he will always pay 100 000 Kshs to every Mp to attend and be seen alongside him. That is why he is very popular with broke first time young MPs like Kuttuny and Dr. Kones.

He cherishes an aura of a wealthy man. On Harambees, he will contribute generously to curry favor with the public. When it comes to his employees, family or an individual without influence, the case shifts dramatically. He can’t part with a dime. He only invests where he is sure of maximum political returns. Woe unto you, if he owes you any money, he never services his debts. Even bills. Power disconnections are common in his house!

Resources

Resources are a very important factor in winning a presidential race in Kenya. A well oiled campaign machinery requires an upward of Kshs 2 Billion. Ruto is worth but an eighth of this.

That Ruto is a very wealthy man is nothing but a myth. He is a man of means but not as much he would want us to believe. His hubris, flamboyance and ostentations have helped perpetuate this myth amongst the innocent public. In 2006 and up to 2007, Ruto was at the verge of bankruptcy. He was running a costly campaign backed by insufficient resources and unwilling donors. His salary in parliament was a paltry Kshs 100 000 because of loans. He was earning Kshs 300 000 per week as allowances in AMACO, 1.5 Million from rent in Eastons Apartment and Kshs 300 000 from rent in Matiny property in Rongai and yet his campaign budget was Kshs 2 Million per week. There was a huge gap that had to be filled. His major donor, Mr. Joshua Kulei was fatigued. Yagnesh Devani of Triton was getting pissed off. Harambee checques were bouncing by the dozens. Moi was fighting him with money that he could not match. He was in dire straits. To bridge the expenditure gap, he withdrew more and more from AMACO driving it almost belly-up.

He begged for cash left, right and centre. His home in Karen was up for auction by HFCK over unpaid mortgage to the tune of Kshs 3 Million and ditto for his houses in Rongai. Transnational Bank was threatening to sue over a 6 Million overdraft.

He was a man under siege. He sold off his plots in Nairobi but the reprieve didn’t last long. All along people used to claim he had cash stashed in foreign accounts but it was untrue. Kulei upped his weekly handout to Kshs 200 000 per week but it was insufficient. He wanted to be seen flush with cash but the image was too expensive to sustain. When he was an inch to the cliff the Raila presidential campaigns came. It was such a relief for him.

He harassed Asian tycoons to contribute to the ODM kitty through him. He is such a formidable resource mobilizer. He applied the YK 92 tactics. Money flowed in millions. The money did not get to the ODM secretariat but he utilized it to sort his financial woes and fund ODM Members of Parliament in Rift Valley, Upper Eastern, Coast, North Eastern and some in Western Kenya. Each to a tune of between 1.2 Million and 3 Million. Some of the lackeys and poodles namely Aden Duale, Ababu Namwamba, Dr Julius Kones, Charles Keter, Joshua Kuttuny and many others following him around owe their allegiance to this money.

His financial godfather Mr. Joshua Kulei gave him a whopping Kshs 300 Million in cash and a white Range Rover ( it carried a KAG registration but was changed to KAW 583) 60 Million of which he forwarded to ODM Secretariat and kept the rest. Former Triton tycoon, Mr. Yagnesh Devani, gave him 50 Million and a green Mercedes Benz E 350 (formerly carried a KAM registration but was irregularly plated KAW 600 Q, same as his green Range Rover 4.8). Not a single cent got to the ODM kitty. Kabuito Contractors magnate gave him Kshs 10 Million and a white Range Rover Discovery. These amongst many other major donors contributed almost 500 Million.

He dazzled and dazed friends and foes alike in the campaign trail with his newly acquired wealth. Even Raila himself was enthralled.

The massive millions he retained were used to jumpstart the construction of the hitherto stalled Weston Hotel (still under construction opposite Wilson airport) bought a farm for Kshs 40 Million from his business partner and MD of AMACO; Mr. Silas Simatwa and renovated his decaying Karen home. He also shilly-shallied with a consultant to build a resort in Karen.

The money he is splashing around is from sugar, maize and fertilizer tendering kickbacks in his Agriculture Ministry. If Ruto was to be fired today, then his presidential ambitions and nationwide campaigns will grind to an immediate halt. This is because he has not improved his investment portfolio since his 06/07 presidential campaigns and his relationship with his bankroller Mr. Kulei is on the rocks. He is liquid owing to his ministerial position and thieving habits but not wealthy. Only addition are the twenty China made lorries he bought from the maize scam proceeds doing transit business registered under BZK, formerly Buzeki.

Ruto’s assets can be summarized in a single paragraph: AMACO, Easton Apartments, Osere Flats in Rongai, Weston Hotel (under construction), Karen Home in Koitobos Road worth 28 Million, Elgon View Home, Sugoi Home and Farm, twenty Lorries (China made). Period. These investments cannot finance a Kshs 8 Billion campaign war chest as it was claimed in a section of the media a few weeks ago.

Campaign Organization

Organization can break or make any campaign. Obama’s campaign was a great success owing to the way he related with his staff and the free hand he gave Mr. David Axelrod to run the campaign.

With the benefit of hindsight from his failed presidential bid in 07, Ruto cannot measure up to the demands of team work necessary in a campaign of this caliber. He believes in one man show. Those who have worked with him will tell you a story of a control freak. He is hardworking, yes, but a presidential campaign is demands a formidable well coordinated campaign secretariat. In 2007, he didn’t have a secretariat but utilized the offices of Katwa and Kemboy Advocates. His ‘secretariat’ members were made up of Katwa Kigen and Julius Kemboy only. These are the people who wrote his manifesto.

His biggest undoing is money. He never believes in anybody else handling campaign money and never had a budget for the secretariat. He plays accountant, auditor, cashier and everything relating to his money. He never delegates because he believes himself to be perfect. His conceited and bigoted ego cannot allow him to learn any lessons from his 07 presidential debacle.

Since campaigns have become more high-tech and classical campaign methods are giving way to more sophisticated techniques, it remain to be seen whether he will conform. To start with, he is not computer literate; he cannot open mails nor access the internet. How he will utilize social networking sites is hard to fathom. Though he is currently on Facebook, it was his former personal assistant who ran the now dormant account.

Issues

Ruto is generally brilliant but uninformed and miserably knowledgeable. He never reads and neither does he keep himself abreast with international news. He has but one book of political quotes. That is why his speeches are replete with disjointed bookish quotes. He is so uninformed he once asked whether Iran is in South America. He would have made a formidable opponent to anybody had he spared himself some time to read and get informed.

Since he joined politics in 1992, Ruto has written four articles to the press. He has moved only one motion in Parliament. He is an avid debater but he is lacking on policy. He is yet to bring meaningful changes in the Agricultural sector. Scandals are more conspicuous than life enhancing policies. If he was to write a CV applying for the presidency then his credentials can hardly fill a single page. His track record is fit for a new address in Kamiti Maximum Prisons and not State House!

His history does not augur well with the aspirations of many Kenyans who want a clean break from the past. It will be interesting to watch him defend his tainted past in presidential debates. New economic dispensation and an end to corruption are dear issues in the hearts of many a Kenyan electorate. His records are ether bleak, obscure or dirtied in all these accounts.

International Appeal

Ruto’s international credentials leave a lot to be desired for a person who wants to run for presidency. He has zero connections with the international community. His image is tattered by numerous corruption cases that have dogged his political career. The US and the EU once banned him in early 2007 on corruption related issues. That is why he mobilized other ODM luminaries against accompanying Raila on his trip to the US the same year. His Visa has since been reinstated on unclear grounds but it might be cancelled any time in the light of new corruption allegations against him.

Weighed against Raila and Kalonzo, Ruto is an obvious light weight on this score and many other fronts.

In all fairness, it is obvious that chances of William Kipchirchir Ruto ( note that he adopted the name Samoei in 1997 for symbolic reasons, even his ID does not bear it)becoming the fourth president of the Republic of Kenya are tantamount to those of a dog becoming a lion! It is only but a decoy to balkanize and later auction the Kalenjin vote to the highest bidder.

We need to write facts and only facts for public consumption in all issues that touch on our leaders. An article that peddles lies and misrepresents facts in public domain is not only a candidate for libelious prosectuion but downright immoral and unacceptable before the eyes of right thinking minds of the public. If the author of this article escapes punishment, he or she should count his or her luck. This article appears to have been written by one Mr Samoei former PA of the subject, he seems to be very disgruntled and a bitter man, especially after the subject refused to endorse him for the Sotik parliamentary seat against the sitting MP, even though, reliable sources indicate he was given Kshs 700,000 and only garnered 40 votes in sotik by-election, after the sad demise of Hon Lorna Laboso. It is also a public secret that the author took money from the subject on pretense that he would pay for his MBA program at a local university. To add insult to injury, the subject has reportedly sought to distance himself from the bitter author, after receiving ovwerwhelming adverse complaints on the author from the public, including soliciting sexual favors from every female visitor and bribes in order for the author to arrange much sought after appointments with the subject. We hope by pouring his bitterness to the public, his soul and spirit may now go easy.

Kibaki's second term is a criminal term, courtesy of himself

Students awarded grades for exams they never sat

Some students who did not sit last year’s Kenya Certificate of Secondary Education examination were awarded impressive mean grades, the Nation has learnt. The principal of Thurdibuoro Secondary school in Nyando District, Mr Alfred Ochiel, said one of his students who did not attempt the exams was graded. “This candidate in my school abandoned the exams midway. Normally, such candidates are not graded but KNEC decided to give him a D+,” he said. Teachers interviewed who did not want their names mentioned said they knew of a student in a city school who was awarded A- mean grade though he did not sit the exam. Another candidate in the city who was disqualified after being caught cheating was later given a B+ score by the examination council. The outcry over the integrity of the examination council compelled Education minister Sam Ongeri to form a 15 member committee chaired by Kenyatta University vice-chancellor Oliver Mugenda to investigate the results. In Rongo, a candidate who was expelled from school and did not turn up for the exams was awarded an A-. His head teacher was shocked to learn that the boy had “passed” so highly. Education PS Karega Mutahi has downplayed the gravity of the matter. Knec secretary Paul Wasanga said the anomalies will be part of the investigations. He said the team should be given a chance to unearth the details about the computer error or any other cause of the cheating”. Mr Wasanga said with 276,000 candidates, each sitting 22 papers, such mistakes were bound to happen and if discovered the matter will be dealt with accordingly. He said results for candidates who did not sit exams could have been released if other students erred by shading wrong index numbers. However, the examinations chief said he could not rule out anomalies. Mr Wasanga accused some principals of malice for “releasing result slips to the wrong hands and then turning to condemn Knec which they form part of as de facto officials.” He said some candidates could have forgotten their index numbers and marked wrong ones therefore enabling the computer memory to produce results in the programmed formula. He explained that the committee would investigate in detail the errors because in some instances, candidates who sat half the exams or did not complete due to unknown reasons also got results. A principal said one set of results was given in February and another one in March when those who did not sit exams were awarded mean grades. Kenya Post Primary Education Teachers Union secretary general Wanyonyi Buteyo said they would move to court to have the council dissolved because it had compromised the integrity of the country’s academic standards and certificates. Mr Buteyo said the minister was delaying justice but forming a probe committee in a clear case of incompetence.

Making the Reconciliation work for all

Mr Kibaki has a way of reinventing himself; at least we think he forced himself into history books against the backdrop of a stolen election. By turning up in parliament to debate and vote for the crucial bill meant to legalize his peace deal with Mr Raila Odinga, he became the first president to do it in Kenya. But that symbolically was not enough. The president literally sat in parliament to await the final document to entrench the deal into the constitution and before he retired to State House, he had signed it into law. That is vintage Kibaki, the man Kenya has not known for five years.

There was more. While contributing to the bill, Mr Kibaki joked about letting James Orengo single-handedly write the constitution. All these things that we have been saying, he knows them and he can write a new constitution, he quipped. As expected, the house went baaah with laughter. It is good that ends well. But where did it begin?

While the powerful men and women endorsed the entrenchment of the peace deal in the constitution by 200 votes to nil, other Kenyans are counting loses. The peace deal has to hold, it must never fail. Kenya should not be allowed to go that way again, ever. In order to prevent the recurrence of the slaughter of innocent lives and destruction of property, Kenyans have the best opportunity in our lives to step back and reexamine ourselves. Why did it begin in the first place? Why did we see the level of bestiality that we witnessed? Because we have lived a big lie for a whole half a century. It was bound to come; thank God it came during this generation.

Now back to the reconciliation and national healing. Kenyans hurt each other; lives were maimed and disfigured while livelong investments were reduced to ashes. Nothing is more painful than the over 2000 lives lost in gory death rituals at the hands of militia and the trigger-happy police. So, while the smiling MPs kiss and hug and high-five to celebrate the success of the Kofi Annan miracle for Kenya, we should look back at the pile of earths jutting out of countless homes.

Those raw earths mark a very unfortunate entry into 2008 for countless Kenyan families whose loved ones are buried therein. They paid the ultimate price. From Onyango to Kipkoech to Wasike to Karanja to Omar, Kenyans of all tribes were felled by fellow Kenyans either taking the law into their own hands or acting at the behest of shadowy power barons and financiers with stakes in government power. To the funding warlords, only one thing made sense to them, propping the illegal regime in power to serve as a conduit to intimidation and award of government tenders and contracts. They care less, and did not even show up at the funerals of the dead youth and women. To them, dead combatants are a statistic.

An election was stolen. Start with the cabinet strong men and women, beginning with Saitoti whose reelection in Kajiado North was contested against the backdrop of allegations of importation of premarked ballots. Talk of Maina Kamanda, croco-coward Mungatana, Koinange street client Mwakwere and the thief in chief Kibaki. The ECK was complacent and complicit in that heist of the electoral victory. Karua, Me Chuki, Kimunya and premier Warlord Uhuru are culpable. So are Murungi and the blood thirsty church that went on leave while Kenyans slaughtered each other.

We foresee that the powermen and women will negotiate a way out of their guilt with blackmail and other tools in their arsenal. What happens to the displaced Kenyans, suppressed to a PR figure of half a million? What happens to the lost time, which was not spent tending the crop and animals. What happens to their children who went to school without fees because the parents were rendered jobless and their savings destroyed. What happens to the broken families, forced to separate from their loved ones simply because they had dared experiment with cross-cultural, inter-tribal marriages?

If this reconciliation is to make sense to the mourning homes and agonising villages, amnesty must be sought for all the incarcerated youth and women. They must be set free and let to reunite with their families. There is simply no justification why Saitoti should contemplate judging anybody when he himself is tainted and guilty. The police lack the moral authority to prosecute crime, they are criminals, worse than the arsonists. Martha Karua's courts cannot proffer charges against convicts because the CJ presided over an illegality by participating and presiding over a twilight swearing-in of bandits. A criminal like the CJ cannot prosecute and judge other alleged criminals. There ought to be no two standards to the law. It must apply ruthlessly and without prejudice to the law-breaker.

If we need the reconciliation to be celebrated by all Kenyans, address the land question now. We have published a borrowed expose here on how Kibaki, Moi and other operatives own Kenya. This must be reversed. A productive country is measured on how well it utilizes her natural resources. Moi's and Kibaki's land acquisition, together with those of the Kenyatta families provided this country with breeding grounds for pests and snakes. They are under-utilized by people whose only land is actually a 3-by-6, their graves. Why do they need land the size of Nyanza province when they cannot take it anywhere? If they got it through the right channels it may be another story. But these people used their exalted positions to benefit from the state largesse. This must be reversed and there is no better time to do that than now.

The villager who is nursing gunshot wounds, the family whose father was felled by a gunshot, the woman who was raped by goons, and the elder who was forcefully circumcised and infected with HIV must be included in the reconciliation. There must be recompense for the maimed, the imprisoned, the dead and the prime beneficiaries of the peace deal. If Kenyans had accepted the heist and said live and let live, the world was not going to bother. The truth be told. It is only after the world witnessed the bestial way in which goons were chasing and cornering harmless Kenyans that they were jerked to a catastrophe in the making. Only when the police were got on camera dousing homes and mowing down armless youth did the world wake up to a Kenya that was sinking to the abyss. Kofi Annan did not come to Kenya because he liked what the peoples' president Raila was saying. Certainly it is not what Disinformationsmeister Mutua was saying.

The world, from Washington to Westminster to Berlin and Paris was shocked by the level of deaths in Kenya. Those who paid the ultimate price are the ones who drove the urgency into an arrogant world that had let Rwanda sink only a decade earlier. We cannot afford to let the departed be forgotten. While we think of resettling the displaced, let us spare a moment for those who are forever displaced. While we compensate the living for their lost businesses, we ought to compensate for the death of the true heroes of our third liberation.

We must build a tablet reminder with a vow never to allow vote theft in Kenya ever again. We must honor our departed with a suitable plaque on which must be embossed their names and the reason they died:

These people died after Mr Samuel Kivuitu participated in an illegality by agreeing to issue a victory certificate to a petty election thief called Mwai Kibaki. They died to free this country from election thieves and corruption. By paying the ultimate price, they forced Kenyans to reexamine cheating in national elections, national exams and land as well as national resource allocations. They died to inspire the rewriting of a new people-friendly constitution. After their deaths, many more children were born to a safe and fair country and this country looks back at that period to draw lessons never again to let it repeated.

That is the message we would like to see embossed on all the plaques in the country declaring the travesty of 2007 a turning point and a governance watershed in Kenya.

This message must live for generations, in each of the burnt-out business, church, home and street. Kenyans must use this as a repugnant reminder never to let it happen again.

Reconciliation must trickle down to the homestead, for when the trauma of a lost son and a miscarried foetus is overcome shall we join and sing together the beautiful words of our national anthem. Before that is done, the tune and the words are irritating noise and a nuisance to Kenyans.

Kenya must move forward, but we must not forget to immortalise the travesty that was committed in December 2007. By keeping the memory alive, we will be spurred to avoid a repeat of those scenes of butchery that we witnessed. Kenya must never allow cowards like Kivuitu to claim to burn and die with us for we know for sure that he is unshaken by the consequence of his cowardize and betrayal. Nor should we ever condone the impunity of power barons.

Was Warlord-in-Chief Uhuru Kenyatta bribed to alter civic nominations list?

Recently, national coward Samuel Kivuitu complained that Local Government Minister and premier mungiki financier Mr Uhuru Kenyatta had irregularly nominated 100 kanjoras contrary to the list that was forwarded by the disgraced ECK. Today, it emerged that the minister's PA, another bandit called Njoroge Kariuki was arrested by the feckless Kenya Anti-Corruption Authority, KACA while receiving a fifth of the one million he should have been paid to facilitate the payee's nomination to the Nairobi City Council. Questions are, by paying a million bob, how much does a kanjora expect to earn? The most important question is, how clean is Uhuru in this a-million-for-nomination-scandal?

Kariuki was arrested on Tuesday at his Jogoo House offices by officers from the Kenya Anti-Corruption Commission (KACC) after he allegedly received Sh200, 000 from a person who was seeking to be nominated as a councillor at the Nairobi City Council.

According to the police, the money was part of Sh1 million the suspect had demanded from Ms Halima Saloo, who was seeking the nomination.

According to a statement from KACC, Kariuki was arraigned in court at 3pm facing charges of soliciting and receiving a bribe, contrary to Section 39 (a) as read with Section 48 (1) of the Anti-Corruption and Economic Crimes Act 20.

But speaking at his offices yesterday, Uhuru denied that Kariuki was not his PA but was only involved in the civic elections exercise.

However, the minister called on the investigating authorities to get to the bottom of the matter and ensure that justice was done.

Kariuki was yesterday charged before Nairobi Principal Magistrate, Lilian Mutende, who released him on a Sh250, 000 bond and a surety of the same amount. “I cannot defend him. This should serve as an example to other officers who are tempted to engage in corruption in the ministry where I am the head. They will not survive,” said Uhuru.

This came after a storm was raised in the run up to mayoral elections where some names of nominated councillors were struck off the list published by the minister.

Among the cases was that of Adopt-A-Light former managing director, Esther Passaris, over conflict of interest as she had pending cases she has sued the council.

The move resulted in a protracted war of words between Passaris and former Nairobi mayor and Makadara MP Dick Wathika, whom she accused of cancelling most of her contracts entered into with the council.

But in her defence to the minister’s assertions, Passaris said she was a different entity from her company, and hence, the minister should never have used it as a reason to reject her nomination.

Meanwhile, a crucial document in the Sh64 million fraud charge leveled against a director of East African Safari Express is missing from the registrar’s office, a court heard yesterday.

The prosecutor, Elias Njeru, told Senior Principal Magistrate Rose Ougo the document he wanted to use in a case against Antony Kegode was missing from the registrar’s file.

Kegode is charged with obtaining Sh64,188,487 by pretending that an aircraft he offered as security belonged to his company, East African Safari Air Express Ltd, based at Wilson Airport. The case will be heard on April l6, l7 and l8.

Kibaki's Top-up election rigging extended to Mitihani House?

Something is not adding up in the Kenya National Examinations Council, 2007 results for the fourth formers. After releasing the results in the thick of the haggling over a stolen election, the suave Prof Sam Ongeri and the discredited Kenya National Examinations Council has gone ahead and recalled some results. We are witnessing institutional collapse in Kenya, whether we like to face the truth or not.

Is KNEC another ECK? Are the institutions curtseying at the stinking feet of power mongers and influence peddlers who went behind our back to tamper with the results while the country was transfixed on a stolen democracy? Was there top-up for some candidates and regions which were PNU-positive? Questions for which we have no answers but which, nonetheless, our countless army of readers are asking for an explanation.

What shocked people was the slump in the performance of traditional academic powerhouses like Alliance High School, an Alma mater of many leading Kenya leaders in industry and academia. Alliance sank to position eight, barely making it to the top ten in the rankings. The school blamed it on alleged exam leaks. Wait a minute.

The best girl was ranked 17th nationally, Ms Muzna Hanif Abdulrazak of Agha Khan High School Mombasa has made history of some sorts. The top girl wants to study medicine, good news for the girl-child and the Muslim woman. We congratulate her and all the other girls who did it.

The top school, Mangu, had never been anything near to the apex of national glory for a very long time. Remember that the school produced the powerful individuals in the land, including, yeeeees, bandit president Mwai Kibaki. Alliance Boys has alleged that their competitors had unfair advantage. That they had access to the exam in advance. It is not new. In Moi's Kenya, this was done every year for schools in his native Baringo. But that was the dark era. What is now obvious is the fact that 2007 KCSE has been disputed pitying Alliance and KNEC/Ministry of Education.

It has been claimed in different fora that the KCSE leakage was rampant and nearly every school was aware. Some parents and candidates, not to be left behind, even scrambled and obtained the actual exam papers before they were offered to sit it. The examiners, who themselves may have been complicit in the 'rigging of exams' turned a blind eye on the theft and pilferage of exams. But how?

Claims of Top-ups and Top-downs
There have been claims which we could not verify, involving candidates who registered for, but did not take up the exams, receiving an A for a fictitious test. Mr Kibaki had a top-up of one million votes from constituencies like Maragwa where pregnant women and their unborn children voted. How else would you explain a turn-out of 115%? But what is our seeing a connection here?

Those people who stole the presidency for Mr Kibaki were inept, they failed to balance their books. Obviously, somebody borrowed the top-up magic from Kivuitu's cook-book and decided to cook and serve results. The outcome of that manipulation is that the results don't add up. Those who were known to be weak or had dropped out of school ended up surpassing their superior and hard-working students. How else could this happen? T-O-P-U-P. Remember that for every top-up, there was a T-O-P-D-O-W-N. Was Alliance High School a victim of adjusted 'sambaza' of marks?

The case of the student who registered and failed to take the exam but was awarded a beautiful 93% in maths was reported in a school in the Rift Valley. The headteacher was simply dumbstruck. In a dump move by the KNEC, a girl candidate at Kipsigis Girls High school was entered as a male (M) and nobody noticed this for a girls school in an institution like the KNEC where details are handled with a tooth-comb. No, it was not an error for the student (512103-092, Chepkemoi Judith). By entering her as an M, someone is imprisoning her in endless trips to Mitihani House to effect the correction. Were the ODM zones targeted for punishment by PNU-positive officials at KNEC? Are exam irregularities engineered and managed by computer geeks affiliated to PNU inflicting further damage to the ODM zones?

This blog was contacted by a well-wisher who supports a number of school children in Kenya. We all know that once in a while we come across people who can spare a dollar here and a pence there, which translates to a lot of money in Kenya shillings. The distraught benefactor was concerned and we reproduce their email for you to see why this exam fiasco is not a local village matter, the whole world is seeing what we are going through and the credibility of our school leavers will be called to question, believe us.

I know for a fact that the lives of thousands of young adults have been messed but this. We have the benefit of paying our relatives an repeat year. But what about those who cannot afford this? They have now failed or gotten worse grades than needed for decent studies.Long story cut short: THIS IS A LEVEL 1 SCANDAL OF THE SAME MAGNITUDE AS THE SHOOT-TO-KILL ORDER.

So I wanted to ask you to post this story and some background on your blog so that the exam body and education ministry cannot cover-up the mess. Thank you very much, Tom.

Fellow Kenyans, you can now see where we are going. Education is a must-have in our current life, its life-changing potential cannot be gainsaid. By tampering with exam results through top-up or top-down, somebody has, with the stroke of a pen promoted an undeserving kid and killed the spirit of a patriotic and hard-working Kenyan.

How shall we stop this menace? One way is to name names and shame them. Just imagine the damage we did to the thieves and bandits that we tagged on the right of this blog (thief-in-chief, warlord-in-chief, traitor-in-chief, etc which we have received countless times in our private emails from people who consider the tagging to be lethal and very effective). We cannot sit back and watch Kenyan children being graduated into criminal gangs because their progress has simply been reversed. That cannot happen in a Kenya where we want to belong to a country that guards the rights of the weakest while allowing the mighty to rule with responsibility. We are demanding an audit of the KNEC by an independent and credible body of auditors, the results and all the events that took place between the end of marking before Christmas and the release of the results. Were there any faceless criminals who had security passes to restricted areas in Mitihani House? Who are they, and at whose behest were they working? Who knew what, and who was told about it?

In a face-saving move, the KNEC has recalled some exams results. Read that story in the Standard again and pay attention to little geopolitical details. Now, did you notice where the recalled results are coming from? N-Y-E-R-I. Well, one Mwizi Kibaki comes from Othaya in that same N-Y-E-R-I. How about Njiri's High School, is it in Turkana district? Kenyans, what will they do with them? Readjust the results based on what, or is it going to be like the case for Maragwa where the ECK allowed the returning officer was allowed to alter the figures from the exorbitant 115% turnout to the 'arbitrarily acceptable' 84%? Remember that this was done at the ECK, how that figure was arrived at is not really important, it is the kienyeji nature of running institutions that is worrying us.

What is it about these institutions which are run by the Kamba and scandals? ECK is under Kivuitu, ODM-K is under Maanzo and bandit veep Kalooser while the KNEC is chaired by one Prof. Raphael Munavu. We will not forget, shall we, that the PNU bureau of disinformation is led by the Disinformationsmeister Dr Alfred Goebbels Njoroge Mutua. Is it coincidence?

Now Maanzo declares Kalonzo's seat vacant as more intrigue follows the bandit veep

Bandit veep Kalonzo Musyoka's miracles are coming too soon. Look at the picture on the left, he has virtually been displaced to the grass and soil in the street of importance. At the moment, the most outstanding miracle that the peasant boy from Tseikuru can witness is how far he has fallen in the rank of power. He is lucky that on that day, the serial slapper Lucy was not anywhere to be see. Else Kalonzo was to have stepped on the dust proper, where we all are.

And miracles are more overwhelming for the wiper man from Ukambani whose light is dimming so fast that he can't remeber the last time he was loved. As Prime Minister Raila and his entourage of the powerful Pentagon the millions of ODM brigade are climbing, Kalonzo's fortunes are fading.

Soon after deluding himself with ephemeral power of bandit veep, he found himself in an awkward position as the Koffi Anan mediation talks took a roler-coaster towards sustainable peace and long-lasting solution to the problems with Kenya Inc. Kalonzo was breathing hot and cold, rejecting the achievements of power-sharing between peoples' President Raila Odinga and bandit Kibaki. We reported it here and analysed the reasons, and the whole country has seen what we saw as Kalonzo's motives.

Now, the registered chairman of the ODM-K and fellow bandit Dan Maanzo who had been promised that he was the first party MP in the tenth parliament when he rusttled the party from Raila Odinga has written to the speaker to declare the defection to PNU by the ODM-K MPS an illegality in law. If speaker Marende follows the laws, according to relevant sections governing the new political parties act, Kalonzo may well be out of parliament.

It will be considered that PNU is trying to crapple with certain embarrassing realities of the ODM-PNU pact which include sharing out of all cabinet, parastatal, PSs, diplomatic and other portfolios on a 50-50 basis. In order to cling to the Finance portfolio, PNU insiders may be tempted to sacrifice Kalonzo so as to retain the instruments of stealing from state coffers. How will Kalonzo, a man with a bloated ego, react to such an embarrassment? We had reported here that Kalonzo may dive to the depreciated opposition benches. The Law Society of Kenya, no less, has urged him to leave and take up the opposition role, much like we anticipated.

Maanzo and Julia Ojiambo have since gone to court to block the nomination of strangers to ODM-K. They feel that they were cheated of an arrangement by Judas Iscariot. Kalonzo's leadership mettle will be taxed as he is called to quell one rebellion after another in his Ukambani backyard.

Apart from the mounting troups aligned against him, Kalonzo has to contend with his nemesis and experienced reform politician, Mama Rainbow Charity Kaluki Ngilu. Mrs Ngilu together PICK Boss John Harun Mwau have little time for Kalonzo who worked overtime to derail their election to parliament. But Kalonzo's grip on Ukambani was dented with the electorate deciding for complete new comers including CCU's Ms Wavinya Ndeti, whose name (wavinya means energetic in Kikamba) resonates well with Mr Mwau's Osa Vinya Mukamba (Be strong Kambas) clarion call. It is known that leading PNU campaigners and casualties of Kalonzo's wiper excitement namely Kivutha Kibwana, John Munyao, Kalembe Ndile and Nyenze are asking PNU to dump Kalonzo as his retention will be equated to a tacit approval of his damaging their efforts to prop up Mr Kibaki's campaign in Ukambani.

Troubles for Vice-President Kalonzo Musyoka seem far from over after his party chairman Daniel Maanzo wrote to the Speaker of the National Assembly to declare the 16 elected seats presently occupied by ODM-K members seats vacant. Maanzo told Speaker Kenneth Marende not to recognize ODM-K MPs who entered into what he termed as “an illegal coalition” with President Mwai Kibaki’s Party of National Unity (PNU) in total breach of Section 40 of the Constitution and Section 17 of the Parliamentary and Presidential Elections Act.

“The law is quite clear that members who have now left ODM-K and joined PNU without the party’s permission have to cease from being MPs Parliament or cannot be acknowledged by the Speaker as ministers of government in the House as such appointments are in breach of the law,” said Maanzo. In a letter dated March 3, 2008 and addressed to Marende, the ODM-K chairman demanded that the 16 MPs, including Kalonzo should vacate their seats forthwith.
Maanzo also wants the Speaker to stop the swearing in ceremony for the two gazetted nominated ODM-K MPs Mohammed Affey and Shakila Abdalla claiming that their appointment were corruptly and fraudulently made. “Mohammed Affey should be degazetted forthwith as his nomination was achieved through corruption and the President should not support appointments reached through such corrupt practices,” said Maanzo.

Maanzo charged that neither the party, nor its duly registered officials approved or was consulted when Kalonzo shepherded his flock to PNU immediately after the General Election and thus the current arrangement where he and Kacheliba MP Samuel Poghisio were sworn in as Cabinet Ministers. “None of our party officials as required under Section 123 of the constitution of Kenya signed any coalition documents between PNU and ODM-K and no such authority was given to any member of ODM-K to defect to PNU.

We will be grateful if you apply the law and stop this serious breach of our law and have it rectified before Parliament resumes its business. He quoted Section 17(6) of the National Assembly and Presidential Elections Act Cap 7 laws of Kenya thus; the concurrence referred to in subsection (5) shall be signified in writing to the President with a copy to the Speaker by the chairman or any other official designated for the purpose by the political party.

Maanzo said the decision by Kalonzo to join PNU and the appointment of the two nominated MPs were executed illegally and without the participation of ODM-K as a political party. He said the law requires the party chairman to signify in writing to the President and the Speaker who is nominated to the Cabinet and to Parliament, a thing the party has not done.

“ODM-K has not designated any of its officials to write to the President or you for the purposes of application of section 17 of the National Assembly and Presidential Elections Act Capt 7 in Parliament nor have I done it in any capacity as the chairman of ODM-K. I learnt from the press that ODM-KJ Members of Parliament had formed a coalition with PNU and subsequently two of our elected MPs were appointed to the Cabinet,” he said.

Noting that he learnt of the appointment of Kalonzo and Information and Communications Minister Samuel Poghisio in the press, Maanzo argued that their appointment was in breach of Section 40 of the Constitution of Kenya and Section 17 of the National Assembly and Presidential Elections Act.

“It is our opinion that unless otherwise proven that the 16 elected MPs under ODM-K ticket have not breached Section 40 of the country’s Constitution and Section 17 of Cap 7 and are likely to continue to breaching the law should “vacate their seats forthwith” he noted.. Subsequently, Maanzo told Marende not to swear in the two nominated MPs into the Tenth Parliament saying that their nomination should be revoked and repeated so that Section 33 of the Constitution of the Republic of Kenya is complied with by involving the party in nominations

Where is the first lady?

Parliament was officially opened by Mr Kibaki on Thursdays to usher in a very optimistic moment in Kenya reminiscent of the 2002 swearing in of the third president of the republic on a wheel chair. This optimism was captured in various pictorial displays, including Prime Minister Raila Odinga strolling into the chamber with bandit veep Kalonzo Musyoka, aka Judas Iscariot.

No one may have imagined this trouping of the politicians to the August House after the acrimonious first session during which the MPs-elect were sworn in a very entertaining and tense environment. The beginning of the second session of the 10th parliament.

The exuberance of the befitting occasion was denied the usual drama surrounding the choleric first lady who is reportedly tethered to her Muthaiga home after a series of embarrassing slapping episodes. Serial slapper Lucy has quite a collection in her gallery of victims, ranging from haranguing former veep the likeable Moody Awori to slapping a senior civil servant at the hallowed lawns of State House during a state function. Her latest victims include retired Mzee Moi and bandit veep Kalonzo who are reported to have avoided the slap but were left thoroughly embarrassed by the drama.

Mrs Kibaki, it will be recalled assaulted Mr Gitobu Imanyara whose Nchuri Ncheke elders have since sent out word for a he-goat. We reported right here earlier that Lucy had shot her son, Jimmy, following disagreements over whether bandit Kibaki should hand over power to ODM or not. What caught the observers of the state opening of parliament was the loud absence of a first lady that Kenyans have grown to hate and love with equal measure for her dress code (if she has any), hair wigs and steady gait beside Mr Kibaki in all state functions.

At the state opening of Parliament, it was her daughter Judy who sat close, but not next, to the Prime Lady Ida Odinga. Where was Lucy? Town is rife with rumors of her whereabouts including her open disdain for the non-Gema and obvious unease with the way her husband ceded power to Prime Minister Raila Odinga.

Insiders report that the recent rise in activity by bandit Kibaki at his Harambee House offices is tied to an attempt to deflect attention from his schizophrenic wife. Mrs Kibaki, a humble primary school teacher who rose with her husbands stature has four children with Mr Kibaki. Mr Kibaki has another daughter by his second wife, Wamboi. Ms Mwai is dating one of the obnoxious Armenian brothers who ran amock in Nairobi in the recent past including causing a breach of security protocol at JKIA. The notorious drug dealers later revealed sensationally that they were hired to bring down some targeted politicians. Kenyans will remember that bandit veep Kalonzo had rushed to a photo session with the criminal brothers at the Grand Regency Hotel.

On a serious note, were Lucy to have attended that state function, we cannot fail to speculate the likelihood of her stretching her hand to 'greet' the Prime Lady Ida with a spank.

On a day like this when the world remembers women, on the international women's day, we cannot fail to ask two questions: One, where is Lucy Muthoni Kibaki? The second question is, what do we call Mrs Ida Odinga whose posture and clout is certain to eclipse the sadistic Lucy? We propose that the Prime Minister's wife be called the 'Prime Lady' to distinguish her from the bandit lady Lucy.

You have killed thousands of our young men whose only crime is being poor and unemployed on the pretext that you are “crashing”and wiping out “mungiki”. Only recently, you murdered Boniface Maina and his wife Elizabeth Nyambura in cold blood and dumped their bodies at Karura forest.

Their young children are now orphans. And you entrusted the crashing to Kimendero the crusher to continue and finish the job he was doing in the 1950’s! You can rely on the pseudo mungiki youths who in truth are merchants on hire claiming the brand name mungiki.Before on behalf of the Community we confront those in the country who think they can isolate and exterminate the Kikuyu community, we shall sort you out first.

State 'sanctioned' Kenyan clashes and killings by Mungiki

Having been asked to defend the bandit government in its times of crisis, Mungiki now feels short-changed and abandoned, we can reliably report. This morning, members of the gang were caught up in police running battles in which tear gas cannisters were lobbed to disperse them. They were protesting the incaceration of their leader Maina Njenga. We recently reported that Njenga was still Mungiki, and not many people took us seriously.

And in what is likely to hurt the PNU thugs, the BBC has learnt of allegations of state-sanctioned violence in Kenya during the recent post-poll crisis. Sources allege that meetings were hosted at the official residence of the president between the banned Mungiki militia and senior government figures. The aim was to hire them as a defence force in the Rift Valley to protect the president's Kikuyu community. The government has declined to respond to the allegations which are likely to be investigated by a new commission.

The allegations come as parliament is due to open on Thursday preparing the way for a new coalition government. Although parliament's focus will be on healing ethnic divisions and creating a coalition government - allegations of state involvement with a banned Kikuyu militia, known as Mungiki, will not go ignored. Not least because of growing suspicion that some of the violence that led to 1,500 people being killed and hundreds of thousands displaced was orchestrated by both sides of the political divide.

Gangs with machetes The BBC source, who is a member of the Kikuyu tribe and who is now in hiding after receiving death threats, alleged: "Three members of the gang met at State House... and after the elections and the violence the militias were called again and they were given a duty to defend the Kikuyu in Rift Valley and we know they were there in numbers."

On the weekend of 25 January, the Rift Valley towns of Nakuru and then Naivasha were the focus of the some of the worst post-election violence. Eyewitnesses spoke of non-Kikuyu homes being marked, then gangs with machetes - who they claim were Mungiki - attacked people who were from other ethnic groups. Sources inside the Mungiki have told the BBC that it was a renegade branch of the outfit that was responsible for violence, not them.

A policeman who was on duty at the time, who has spoken to the BBC on condition of anonymity, has also pointed to clear signs of state complicity. He alleges that in the hours before the violence in Nakuru, police officers had orders not to stop a convoy of minibus taxis, called "matatus", packed with men when they arrived at police checkpoints. "When we were there... I saw about 12 of them [matatus] packed with men," he said.

"There were no females... I could see they were armed. "We were ordered not to stop the vehicles to allow them to go." The current and previous minister for internal security have both been invited to respond to the allegations. So far they have declined to do so. The allegations come at a time of growing concern that there was pre-planned violence on both sides of the political fence, in the aftermath of Kenya's disputed election result.

The International Crisis Group has already raised such concerns in their report and Human Rights Watch is expected to publish its report making similar claims shortly. There are plans to establish a Truth and Reconciliation Commission in the coming weeks to examine claims of election violence. The allegations are likely to be among the themes investigated by a commission created to address the issue of post-election skirmishes.

This may be the beginning of a long drawn out war between Mungiki and the Grand Coalition. It is believed that Mungiki adherents are fearing for a merciless clampdown by the police whose minister is likely to be from the ODM. Time to go look for the warlords who helped recruit the mungiki is now. The group has been hunted down and killed before including their bodies being dumped at the Ngong Forest.

Body language: What will Kibaki and PNU be doing?

Two great things happened in Kenya yesterday. Kenyans witnessed what should have been done in 2002. Then they said 'Happy new year' to each other. Kenya ushered in a new chapter, but did she?

Look at this picture on the left. Certainly, Kibaki was not saying happy new year to Prime Minister Raila. PNU has no year to be happy about. At the beginning of the fight for justice in Kenya, PNU under-estimated the well guarded script that ODM held so close and dear.

When the Peoples' Prime Minister called for international mediators, no less than the bandit veep Kalooser Musyoka who must rue his bloated ego said Kenya needed none of that. Conspicuously absent at the historic signing of the truce and power-sharing arrangement, Kalooser has definitely lost his place of privilege in the new power arrangements. As a member of the government, he will be answerable to Peoples' PM Raila. Some of us entertain the thought that he may dive out of government to earn some freedom as a depreciated and crest-fallen leader of a colorless opposition. But who cares, the two pre-eminent bandits lost the election and they were imposing themselves on the people of Kenya. Their time has come to an abrupt end, unceremoniously.

Yet the fight has barely begun. Hold your horses, don't pop the champagne yet. If you critically look at the outcome of this agreement, and the weight of the backers who crafted and countersigned it, you will notice that PNU did not get what they wanted in the deal. They lost government and face. They will attempt to stymie the government by hanging to the state. Watch out.

They began by asking the ODM to go to court. But the Peoples' government would have none of it. The courts are infested with bandit appointees who would do anything to please the paymaster. Marionettes have no life of their own; strings are pulled by the one who desires the type of dance they want. Who would have imagined that PNU and the Kenyan courts would be so discredited as to lack respect? Yet this must be undone and confidence re-imbued on the Kenyan people. The country’s legal credibility must be regained and edged on permanent premises of fairness.

PNU's arguments for the ODM to run to court were basically based on their own poorly scripted riot act, assuming they had any. It was expected by the bandits that after stealing the election, PNU would entertain the ODM in endless court battles lasting for as long as they wanted power. Previous elections petitions in Kenya have yet to be settled well into subsequent terms. The law does not apply in retrospect, so what happens if a petition court finds out that someone served a full five years in parliament, albeit illegally? Nothing. It will be time-barred, and that is it.

The call for international mediation was met with retorts of "We are a sovereign state, we are not at war and this internal matter cannot be mediated by external people". Bandit veep Kalooser is a loser. He even hyped some inexistent magic wand to show that he 'created peace' (sic) for Somali and Sudan. As a celebrated peacemaker (in his delusionary hyper-inflation of a porous ego), he warned that he could bring the warring parties together. Judas Iscariot mediating between the bandits (of whom he is part) and the people of Kenya? Nope. ODM insisted on Kofi Annan after John Kufuor was derided as being too thirsty for Kenyan tea. PNU's disinformation agent Dr Goebbels Njoroge Mutua never spared a moment to deride the ODM in his Thursday briefs and paid up adverts that insult the intellect of Kenyans.

Rattlesnake Me Chuki, not to be left behind in the competition of the absurd, weighed in by saying that the mediators were coming at the instigation and invitation of ODM. Government (sic) was intact and legal. He said other senseless things that he must be busy looking for a capable system to rescind and vaporise from our minds. But he wont, it is embedded in our psyches and those of our toddlers who have watched everything with their teeth.

Nothing is as remarkable as PNU's lack of a framework. ODM went into the mediation talks, which PNU christened 'dialogue', with several case scenarios. PNU went there to lecture us on the sanctity of a constitution that they blatantly raped and defiled. Someone has taught us that if one wanted to benefit from any law, they ought to begin by respecting it. PNU trampled on the constitution of Kenya and then they were least prepared for the eventuality. Things, having fallen apart even after hiring the Kalooser outfit and the brains behind the most monumental of Moi’s scams, Mutula Kilonzo, they still could not hoodwink the international community into buying their jaundiced thinking.

Bandits suffer from some defect of some sort. PNU bandits suffered extreme cases of selective amnesia. On its mediation panel was a rabid and foul-mouthed Karua, whose disdain for men and love for power can be explained by nothing but her intimate knowledge of masked scoundrels called men of the cloth. Having dated a priest, she knows men for who they are. To here they chase skirts and nothing else. She was shocked by the firmness of the international community. They were not going to hear anything like appointing a PM under the current constitution by a man who has no respect for covenants.

First Kofi Annan, to prove his mettle and diplomacy, crafted four main steps towards resolving the problem in Kenya. We salute this son of Africa for showing utmost patience and astute leadership of the process.

But we hasten to warn everybody. It is not yet time to celebrate. Over 1500 souls have perished and yesterday Mr Kibaki made it clear “wale ambao wamepotea, basi wamepotea”. Heartless brute this man. May be we should revisit Lucifer’s slapping sprees and try to understand the genesis. Lucifer must have known that the only language that Baba Jimmy could understand was a slap. Kibaki did not speak as the President of Kenya after the signing ceremony. PM Raila was the inspiring and encouraging pragmatist. Kikwete almost said what Kibaki should have said. But we wonder who the bandit speechwriters are.

We warn Kenyans to not sleep. PNU has lost everything they wanted to steal and keep. And they will not take it lying down. They are sure to stage a fight-back. While they do this, we, the Kenyan bloggers who have kept the country in the international limelight must sustain our vigil for any dishonouring of the agreement. We demand certain visible powers be ceded to PM Raila. He needs to run government and initiate reforms that inspire business and jobs creation. We need parity in wealth distribution and a federal constitution nothing less. We want no games and we have to remain on guard for the Kenyan people.

If you doubt our caution, look again at Bandit Kibaki and decipher the message he is giving to PM Raila. What happens to the stakeholders of the banditry namely Moi, Kalonzo and all the others.

Meanwhile ODM must hand back the Health ministry to mama Rainbow Charity Ngilu ASAP.

Records contradict minister

THE Government signed an Anglo Leasing contract for the supply of Sh500 million security telecommunication system in 2003, court documents show.

In a petition and affidavits filed in the Central Registry of the High Court by Midland Finance Securities Limited of Switzerland and Globetel Incorporation of Cambridge, UK, the documents contradict the dates given by Finance minister, Mr Amos Kimunya. Earlier yesterday, Kimunya had claimed, the contracts were signed during the Kanu regime.

A director of the two companies, Mr David Dunkley, says the Government entered into the contract for the installation and commissioning of a Nationwide Digital Multi-channel Security system on May 29, 2003. Globetel Inc was to supply the communication system to the Administration Police. On the same day, the Government entered into a credit-financing contract with Midland for the first phase of the security contract.

The credit was to be repaid within 72 months from the date the agreement became effective. “The credit contract and the security contract were subject to the laws of England,” he says. The contract, Dunkley says, was to last two years from the date of execution. “Indeed a legal opinion was accordingly issued by the Attorney General, Mr Amos Wako, on June 17, 2003,” he claims. The UK-based company immediately embarked shipment of the equipment in the interest of the timely completion of the contract, Dunkley says in his affidavit.

“As a consequence, Globetel Inc purchased the necessary equipment for installation, had it inspected and shipped in accordance with the agreement, to Mombasa,” he adds.
The two companies also filed a case before a constitutional court on April 4, seeking orders quashing the Government’s decision to hire PriceWaterHouse Coopers to investigate the contract. They also want the AG and the Kenya Anti-corruption Commission or their agentsrestrained from arresting or preferring any criminal charges against them, their shareholders, agents, directors or contractors.

The companies want the court to declare illegal and uncontractual attempts by Government to criminalise the commercial dispute between itself and the petitioners.They contend that the agreements were entered into on the strength of AG’s legal opinion and were, therefore, lawful and do not warrant scrutiny by the audit firm contracted by the Ministry of Finance.

Hearing of the case failed to kick off, yesterday, when a Nairobi advocate, Mr Fred Ngatia, told the court he had instructions from the two companies, to join their advocate, Mr Kyalo Mbobu, in arguing the case. Ngatia told Justice Joseph Nyamu that he needs time to prepare his arguments, a request the judge granted.

The judge ordered that the case be heard on February 11, next year.

Hope against reality: Does Kenya show indications of a collapsed State?

Bandit president Kibaki and traitor-in-chief Kalonzo Musyoka together control a willing two provinces. Six provinces in Kenya do not recognise the bandit government, are not willing to accept to be ruled by bandits and are running their affairs in a 'state within a state manner'. Today, Sunday 17 Feb 2008, Kosovo has declared independence from Serbia. Kosovo, a former province of Serbia covers an area of 10,887 sq. km, roughly the size of Connecticut and one third the size of Belgium (30,528 sq. km). Kenya's Rift Valley Province covers 173,854 sq. km, a whooping 16 times the size of Kosovo.

Kosovo has been run by the UN and NATO since 1999, when Slobodan Milosevic's forces were ousted after a NATO air war launched to end his crackdown on ethnic Albanian separatists. It has a population of 2m, mainly 90% ethnic Albanians. Muslims make up the majority, with Catholics and Christian Serbs.

Is it time for Kenya to pull away from the imposed hegemony from Kirinyaga? Should Kenya declare independence from Nairobi and leave the thieving bandits to turn on themselves? Some analysts are saying nothing short of a devolved government will save Kenya. In the devolved system, which should borrow from the ODM manifesto, Nairobi will be retained as the nominal capital of a weakened central government. Wealth and administrative authority will be ceded to the periphery. People who have argued that Kenya (580,367 sq. km) is too small to devolve fail to appreciate the truth about such small but viable countries like Belgium. For starters, Belgium is about one-twentieth the size Kenya and yet its GDP seven times that of Kenya.

Do we have any semblance of government in Kenya? What is the definition of a state? Nation? What makes for the sovereignty of the state? Conventionally, you cannot rule over an unwilling population. Bandit president Kibaki is imposing his illegitimate will on an unwilling country.

By definition, A state is a political association with effective sovereignty over a geographic area. It may mean a nation state or a sub-national state. A state usually includes the set of institutions that claim the authority to make the rules that govern the exercise of coercive violence for the people of the society in that territory, though its status as a state often depends in part on being recognized by a number of other states as having internal and external sovereignty over it. The banditry of Mwai Kibaki has been rejected by the international community, which 75% of Kenya refuses to recognise it. What is the state of the state in Kenya?

A nation is a form of self-defined cultural and social community. Though a nation is not identical to a state, the people of a nation-state consider themselves a nation; while traditionally monocultural, it may also be multicultural in its self-definition. The term nation is often used as a synonym for ethnic group (sometimes "ethnos"), but although ethnicity is now one of the most important aspects of cultural or social identity, people with the same ethnic origin may live in different nation-states and be treated as members of separate nations for that reason.

Signs are that Kenya is a collapsed state. Look at the symptoms of failure and judge for yourself whether Kenya is gone to the dogs.

Indicators of a collapsed State

1. Reliance on private security for safety and security, without which one feels threatened;

2. Privatized food security, basic education, health and livelihoods, mainly through reliance on charity. The general population psyche is that the government has a minimal role, and is cynical of their basic priorities;

3. Systemic conflict, with no clarity on how it will be addressed, and the population accepting it as a norm;

4. Adulterated justice system which often appears "bought/hijacked" , hence trust in them is minimal;

5. Community level governance abused, hijacked, marginalized, or openly threatened;

6. In national institutions, checks and balances tempered with for example in: procurements, payments for goods and services, recruitments, promotions and deployments, and the targeting of support in survival safety nets (e.g. bursaries, health, justice for the poor among others);

7. Misuse and misallocation/ misapplication of national resources: Purchases of luxury goods at the expense of basic essentials (Cars, trucks, natural resources, other immovable assets);

8. Systematic and personalized threats meant to cow a person(s) perceived to be a threat from exercising their rights (it takes many forms);

9. Collapsed infrastructure and utilities, that do not get preventive maintenance, and when done, the very maintenance acts become revenue generation to individuals involved; hence the state of disrepair is desirable;

10. Competing parallel structures and systems, often between privatized services (owned by politically correct persons) and those that are official, and which are neglected or undermined;

11. Integrity of national institutions tempered with: Citizenship, taxation procedures application, allocation and targeting of support to populations in need;

12. Limited or no support to interventions on equity, promotion of livelihoods and growth;

13. Dramatic privatization of national assets, creating instantaneous millionaires, who then further acquire capacity to undermine the State;

14. Frequent high mortalities from preventable causes: accidents, natural calamities, and systemic violence, often instigated or catalyzed by those who should be protectors of the people;

15. Destruction of the natural environment, often with immediate negative consequences: river catchments, drainage systems, approval of constructions that undermine the environment, and misuse of water;

16. Mushrooming of unplanned structures, for which the Town and Country Planning departments have no powers over. These then quickly lead to domino effects on every other facet of life of the population.
